Terms of Service for Kiosk Merchant Suite
Introduction
- These Terms of Service ("Terms") govern your access to and use of Kiosk Merchant Suite ("Kiosk", "we", "us", or "our"). Kiosk provides a platform and related services that enable merchants to create and manage online storefronts, subscriptions, and related features (the "Services"). By using our Services you agree to these Terms.

- We review subdomain availability and host your store; subdomain assignment is final once created.
- We may suspend or terminate accounts that violate these Terms.
1. Eligibility
- You must be at least 18 years old and have the capacity to enter into agreements.
- You represent that any information you provide is true, accurate and up-to-date.
2. Account registration and stores
- When you register, you create an account to manage one or more "stores" (each a "Store"). You are responsible for all activity that occurs under your account.
- Store identifiers (subdomains) are unique and final once confirmed. Choose carefully.
- You must keep your account credentials secure. Notify us immediately of any unauthorized use.
3. Services and changes
- We provide the Services as described in our documentation and onboarding flows. We may add, modify or remove features at our discretion.
- We will strive to provide notice for significant changes; minor changes can be made without prior notice.
4. Fees and payments
- Some features of the Services may be billed. Payment processing is handled by third-party processors (e.g., Stripe or similar). By using paid features you agree to the terms of the payment provider.
- We do not store full payment card data on our servers; that is handled by the payment processor. You are responsible for payment information you provide.
- Fees are non-refundable except where required by law or as expressly stated.
5. User content and acceptable use
- You retain ownership of content you upload ("User Content"). You grant Kiosk a license to host, store, display, and deliver the content as necessary to provide the Services.
- Prohibited content includes illegal material, infringements of third-party rights, malware, and content that breaches privacy or data protection laws.
- We reserve the right to remove or disable access to User Content that violates these Terms or applicable law.
6. Subdomain availability and changes
- When you request a subdomain, we check availability and reserve it. Some subdomain names may be restricted.
- Once a subdomain is published, it may be marked as non-editable or subject to restrictions depending on your plan.
7. Third-party services
- We use third-party services (for hosting, storage, analytics, email, payment processing). These third parties have their own terms and privacy policies.
- You authorize Kiosk to share necessary information with these third parties to provide the Services.
8. Intellectual property
- Kiosk retains rights to the platform, software, trademarks, and documentation. You may not copy, modify, or redistribute Kiosk's platform source code.
- For any content you provide, you represent you have the necessary rights and licenses.
9. Termination and suspension
- We may suspend or terminate your access for violations, illegal activity, or at our discretion.
- Upon termination, we may delete or retain data in accordance with our retention policy. Contact support to request data export prior to termination.
10. Warranties and disclaimers
- THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT PERMITTED BY LAW, KIOSK DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED.
11. Limitation of liability
- TO THE MAXIMUM EXTENT PERMITTED BY LAW, KIOSK WILL NOT BE LIABLE FOR LOST PROFITS, LOST DATA, OR CONSEQUENTIAL, INCIDENTAL, OR SPECIAL DAMAGES.
- OUR AGGREGATE LIABILITY IS LIMITED TO THE AMOUNTS PAID BY YOU TO KIOSK IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
12. Indemnification
- You agree to indemnify and hold Kiosk harmless from claims arising from your use of the Services or violation of these Terms.
13. Governing law and disputes
- These Terms are governed by the laws of the jurisdiction where Kiosk's primary operations are based. You agree to resolve disputes in the courts located in that jurisdiction unless otherwise agreed.
14. Changes to the Terms
- We may update these Terms. Material changes will be accompanied by notice. Continued use after changes constitutes acceptance.
